These Terms of Use (“Agreement”) outline the rules and conditions that govern your access to and use of the Shubhakalyana.com website (“Site”), mobile application (“Application”), and related services (collectively, the “Platform”). The Platform is owned and operated by Shubha Kalyana Matrimony Services Private Limited. This Agreement is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021. By visiting, browsing, registering, or otherwise interacting with the Platform, you agree to be bound by these Terms of Use. If the terms are updated or modified, your continued use of the Platform will be treated as acceptance of the revised Agreement.
Shubhakalyana.com is designed as a digital advertising and matchmaking facilitation service. It enables individuals to create and promote matrimonial profiles, connect with potential partners, and communicate through targeted tools and features. The Platform replaces traditional newspaper classifieds with modern, secure, and user-friendly digital outreach.
Access to the Platform is free of charge. However, Shubhakalyana.com also offers Premium Memberships that provide enhanced features such as:
Shubha Kalyana Matrimony reserves the exclusive right to grant or deny membership to any individual. The company may, at its sole discretion, revise, update, or amend this Agreement at any time. Continued use of the Platform after such changes will be deemed as acceptance of the modified terms.
a. Legal Status of the Platform The Platform functions as an “intermediary” under Section 2(w) of the Information Technology Act, 2000. This Agreement constitutes an electronic record under the Act and applicable Rules. It is generated electronically and does not require physical or digital signatures.
b. Consent to Data Collection & Processing By registering and using the Services, you expressly consent to the collection, storage, processing, usage, and disclosure of your personal and sensitive personal information in accordance with applicable laws. This may include, but is not limited to: contact details, family information, residential address, photographs, and identity verification documents; employment, educational, and financial details (where required for premium memberships); any other information voluntarily submitted or generated through your use of the Platform; and contact information accessed and processed strictly with your consent, for internal training, service enhancement, and analytical purposes.
c. Verification & Safety Measures You further consent to Shubha Kalyana Matrimony engaging third-party tools, agencies, or subcontractors to verify the authenticity of information provided. This may include background checks for criminal or adverse records, undertaken solely to safeguard the interests and safety of Members. Please note that Services cannot be provided without the retention and processing of your personal data.
d. Non-Consent & Withdrawal of Consent If you do not agree to the collection or processing of your personal or sensitive data as described above, you should refrain from registering or using the Platform. If you wish to withdraw your consent or object to the continued collection, processing, or storage of your data, you must discontinue use of the Platform.
a. Legal Competence To register as a Member and access the Services, an individual must be legally competent to enter into a binding contract under the Indian Contract Act, 1872. In addition, the person must have attained the minimum marriageable age prescribed under Indian law — 21 years or above for males and 18 years or above for females.
b. Purpose & Restriction of Membership The Platform is intended exclusively for individuals seeking a lawful matrimonial alliance. Membership is restricted to persons legally eligible to marry under the personal laws applicable to them. The Platform is strictly for personal, non-commercial use, and membership shall be considered void where prohibited by law.
c. User Representations & Warranties By accessing or using the Platform, the User represents and warrants that: they are a natural person (not a company, partnership, or other legal entity); they possess the full legal right, authority, and capacity to enter into this Agreement; they are not subject to any disability, injunction, order, or prohibition issued by a court, tribunal, or competent authority that restricts their ability to marry; the information and content they provide on the Platform is lawfully theirs, accurate, and not illegal, false, misleading, defamatory, obscene, libelous, or invasive of another person's privacy; and they are permitted to share information lawfully owned or controlled by them, provided such sharing complies with applicable laws and these Terms of Use.
d. Bona Fide Intention Members must register with the genuine intention of entering into matrimony. Use of the Platform for casual dating, companionship, immoral, illegal, exploitative, commercial solicitation, or fraudulent purposes is strictly prohibited.
e. Right to Terminate Membership If at any time Shubha Kalyana Matrimony, in its sole discretion, determines or has reasonable grounds to believe that the Member is not eligible for membership, has made false or misleading representations, or has breached any provision of this Agreement or applicable law, Shubha Kalyana Matrimony reserves the unconditional right to suspend or cancel membership and/or terminate access to the Platform immediately, without prior notice and without any obligation to refund any portion of unused subscription fees.
f. Match Suggestions & Member Responsibility Members acknowledge that any match suggestions, communications, or partner recommendations displayed on the Platform are generated algorithmically, based on the partner preferences provided in their profile. These suggestions are intended solely for the Member's personal consideration. Members are strongly advised to independently verify the authenticity, accuracy, and reliability of information shared by other Members, including those profiles carrying a verification badge.
g. Promotional Communications & Privacy Safeguards Shubha Kalyana Matrimony may, from time to time, extend promotional offers or third-party benefits to its Members. However, no personally identifiable information or sensitive personal data will be shared with any third party for such purposes, except as expressly permitted under this Agreement and in strict compliance with the Platform's Privacy Policy and applicable privacy laws. Any sharing of such information shall occur only with the Member's prior, explicit consent.
Members are solely responsible for maintaining the confidentiality of their login credentials, including user ID and OTP, created or assigned during registration on the Platform. All activities carried out under a Member's account shall be deemed to have been conducted by the Member, who shall be fully liable for such actions. By using the Platform, the Member expressly consents to the collection, storage, and use of information relating to their account activities for limited purposes, including the display of curated advertisements, promotional offers, recommendations, and facilitation of information about other Members, in accordance with the Platform's Privacy Policy. Members undertake to promptly notify Shubha Kalyana Matrimony in writing of any actual or suspected unauthorized access to or use of their account, or any other breach of security. Shubha Kalyana Matrimony shall not be held liable for any loss, damage, or liability incurred by the Member or any third party resulting from unauthorized access or use of the account arising from the Member's failure to comply with this clause.
Members are solely responsible for safeguarding the confidentiality of their login credentials, including user ID and OTP. All actions carried out under a Member's account will be deemed to have been performed by the Member. The Member accepts full responsibility for such activities and expressly consents to the Platform collecting, storing, and using information related to their account activity for limited purposes such as displaying curated advertisements, promotional offers, recommendations, and facilitating connections with other Members, in accordance with the Platform's Privacy Policy. Members must promptly notify Shubha Kalyana Matrimony in writing of any actual or suspected unauthorized access to their account or any other breach of security. Shubha Kalyana Matrimony shall not be liable for any loss, damage, or liability suffered by the Member or any third party resulting from unauthorized access or use of the account due to the Member's failure to comply with this obligation.
a. Termination & Suspension Shubha Kalyana Matrimony reserves the right, at its sole discretion, to suspend or terminate a Member's account and access to the Platform without prior notice if the Member is found ineligible under applicable laws or these Terms, if false, misleading, or fraudulent information has been provided, or if the Member engages in conduct that violates this Agreement, applicable law, or the rights of other Members. Upon termination, the Member's access to the Platform will cease immediately. Shubha Kalyana Matrimony shall have no obligation to refund any portion of unused subscription fees.
b. Disclaimer of Warranties The Platform and Services are provided on an “as is” and “as available” basis. Shubha Kalyana Matrimony disclaims all warranties, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement.
c. Limitation of Damages In no event shall Shubha Kalyana Matrimony be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the use of the Platform, including but not limited to loss of data, loss of goodwill, or emotional distress.
a. Monitoring & Review Shubha Kalyana Matrimony reserves the unconditional right, at its sole discretion, to monitor, audit, or review the activity and status of any Member account. Based on such review or internal criteria, the company may restrict, suspend, or terminate access to the Platform, with or without prior notice, subject to due intimation.
b. Consent to Communications By registering, Members expressly consent to receive communications via email, SMS, WhatsApp, and telephone calls from Shubha Kalyana Matrimony and other Members. These communications may include mobile verification, transaction-related OTPs through secure payment gateways, service updates, promotions, and matchmaking suggestions.
c. Override of DND/NCPR Preferences This consent shall override any preferences registered with the Do Not Disturb (DND) Registry or the National Customer Preference Register (NCPR), to the extent permitted by law. All communications will be limited to service-related, transactional, or consent-based messages in compliance with applicable data protection laws.
d. Withdrawal of Consent Members may withdraw consent at any time by deactivating their account or following the process outlined in the Platform's Terms and Conditions and Privacy Policy.
e. Single Profile Policy Each Member may maintain only one profile. Shubha Kalyana Matrimony reserves the right to identify and deactivate duplicate accounts without any obligation to refund subscription fees associated with such profiles.
f. Accuracy of Information & Authorization Members represent and warrant that all information submitted is true, accurate, current, and complete. If a profile is created on behalf of another person (e.g., child, sibling, friend), the Member affirms valid authorization and consent, which must be furnished upon request. Impersonation is a criminal offence under applicable laws, and Shubha Kalyana Matrimony reserves the right to pursue legal action in such cases.
g. Verification Requirements To enhance trust and transparency, Members are encouraged to submit valid government-issued identification (e.g., Driving License, Passport, PAN) and/or complete Selfie Verification. Shubha Kalyana Matrimony may, at its discretion, mandate such verification to unlock certain features (e.g., viewing or sharing contact details, chat access) and will determine the manner and timing of such requirements.
h. Prohibited Off-Platform Conduct While off-platform interactions are not monitored, it is a violation of these Terms to misuse information obtained through the Platform to harass, abuse, threaten, solicit, advertise to, or otherwise contact another Member or employee without explicit consent. Shubha Kalyana Matrimony reserves the right to terminate accounts and initiate legal action in such cases.
i. Determination of Misconduct Shubha Kalyana Matrimony retains sole discretion to determine what constitutes abuse, misconduct, or misuse of the Platform. It may take any action deemed appropriate, including suspension, termination, or legal proceedings, to protect Members, employees, and proprietary interests.
j. Respectful Engagement Members agree to engage respectfully with other Members and employees, particularly during live or interactive features (e.g., Shaadi Meet, Shaadi Live, Near Me). Appropriate conduct, demeanor, and attire are expected. Harassment of any kind will result in immediate suspension or termination.
k. Prohibition of Automated Access Members are strictly prohibited from using automated programs, bots, scripts, spiders, crawlers, or similar technologies to access, interact with, or collect data from the Platform.
l. Message & Content Regulation Shubha Kalyana Matrimony reserves the right, though not obligated, to monitor, screen, or regulate messages exchanged between Members. Any message or content deemed unwarranted, obscene, misleading, or inappropriate may be deleted, and profiles may be removed without prior notice.
m. Safety Protocols Members are expected to exercise reasonable precautions to protect their privacy and ensure safe interactions. Safety guidelines and privacy tips are provided under the “Be Safe Online” section, which Members agree to read and follow.
n. Chat Restrictions & Retention To ensure serious engagement: • Free Members may view chats initiated by subscribed Members only after upgrading to a subscription. • All chat communications will be automatically deleted after 90 days, with no obligation on Shubha Kalyana Matrimony to retain, recover, or provide access thereafter.
a. License Grant Subject to your continued compliance with these Terms of Use and all applicable laws, Shubha Kalyana Matrimony grants you a limited, personal, non-transferable, non-assignable, non-exclusive, revocable, and non-sublicensable license to access and use the Platform and its Services solely for the lawful purpose of seeking a matrimonial alliance, in accordance with the functionality provided.
b. Scope of License This license is granted on a worldwide, royalty-free basis and is restricted to personal use only. The Platform and Services may not be used for commercial purposes, resale, redistribution, public display, or any other use not expressly permitted under these Terms.
c. Reservation of Rights All rights not expressly granted herein remain reserved by Shubha Kalyana Matrimony.
d. Automatic Termination of License This license, and your authorization to access or use the Services, shall automatically terminate without notice upon: i. Any breach of these Terms; ii. Any unauthorized, unlawful, or prohibited use of the Platform; or iii. Suspension or termination of your account by Shubha Kalyana Matrimony.
e. Post-Termination Obligations Upon termination, you must immediately cease all access to and use of the Services and destroy any materials downloaded or obtained through the Platform.
a. Privacy Policy Incorporation Your access to and use of the Platform and Services is subject to Shubha Kalyana Matrimony's Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you confirm that you have read, understood, and agreed to the Privacy Policy, and consent to the collection, use, storage, processing, and disclosure of your personal and sensitive personal data as described therein.
b. Commitment to Privacy Shubha Kalyana Matrimony is committed to safeguarding your privacy and adheres to industry-standard data protection practices and applicable laws. Members are encouraged to review the Privacy Policy regularly to stay informed about how their information is collected and protected.
c. Proprietary Rights Shubha Kalyana Matrimony owns and retains all proprietary rights in the Platform. The Platform contains copyrighted material, trademarks, and other proprietary information belonging to Shubha Kalyana Matrimony and/or its licensors. Except for information in the public domain (such as Member profiles) or where explicit permission has been granted, Users may not copy, modify, publish, transmit, distribute, perform, display, or sell any proprietary information. Any violation may result in immediate termination of membership without refund and may lead to civil and/or criminal legal action.
d. Content Review & Removal Shubha Kalyana Matrimony reserves the right, at its sole discretion, to review, monitor, screen, edit, or delete any listing, profile, communication, image, or other content (“Content”) posted or transmitted through the Platform if such Content: • Violates these Terms, • Is unlawful or offensive, • Infringes intellectual property or privacy rights, • Threatens the safety or reputation of Shubha Kalyana Matrimony, the Platform, or its Members, or • Is otherwise deemed inappropriate, misleading, or harmful.
e. No Liability for Removal Shubha Kalyana Matrimony shall not be liable for the removal of any Content, and such removal shall not entitle the Member to any refund or compensation.
f. License to Use Content By submitting Content to publicly accessible areas of the Platform, you grant Shubha Kalyana Matrimony a worldwide, irrevocable, perpetual, royalty-free, non-exclusive license, with the right to sublicense, to use, store, host, reproduce, adapt, publish, translate, modify, create derivative works, publicly display, and distribute such Content for the purpose of operating, promoting, and improving the Platform and Services, including across affiliated platforms.
g. Sharing of Content You consent to Shubha Kalyana Matrimony sharing or displaying such Content with other registered Members or third parties, subject to the Privacy Policy and applicable laws.
h. Testimonials & Success Stories By submitting testimonials or success stories, including photographs or personal details, you expressly authorize Shubha Kalyana Matrimony to use, reproduce, publish, and publicly display such Content on the Platform and in marketing materials (online or offline) perpetually, without further notice or compensation.
i. Responsibility for Content All Content, whether publicly posted or privately transmitted, is the sole responsibility of the person from whom it originated. Members are solely responsible for the Content they post, upload, share, or transmit. Shubha Kalyana Matrimony does not guarantee the accuracy, integrity, legality, or quality of such Content and disclaims responsibility for any consequences arising from reliance on it.
j. Verification of Information Members are strongly encouraged to independently verify any information or representations made by other Members before making decisions, including those related to matrimonial alliances.
k. Verification of Content Authenticity Shubha Kalyana Matrimony reserves the right to verify the authenticity of any Content posted. Members may be required to provide supporting documentation, and failure to comply may result in suspension or termination of membership without refund.
l. Prohibited Content The following categories of Content are strictly prohibited and may result in immediate account termination, removal of Content, and legal action, including reporting to law enforcement: • Content promoting racism, hatred, bigotry, discrimination, or physical harm. • Harassment, stalking, threats, or targeted abuse. • Junk mail, chain letters, spamming, or unsolicited mass messaging. • False, misleading, defamatory, obscene, libelous, or unlawful material. • Pirated or infringing copyrighted materials. • Pornographic, sexually explicit, or indecent content. • Material exploiting or soliciting minors. • Instructions encouraging illegal activities (e.g., weapons, viruses). • Solicitation of login credentials or sensitive data. • Unauthorized commercial activity (advertising, contests, pyramid schemes). • Content threatening national security, sovereignty, or public order. • Impersonation or false affiliation. • Grossly offensive, abusive, or misleading communications.
m. Compliance with Laws Members must use the Platform in strict compliance with all applicable laws, including those relating to data protection, defamation, obscenity, and intellectual property.
n. Profile Restrictions Members may not include in their publicly visible profile: • Telephone numbers, • Residential addresses, • Personal email addresses, • External URLs/websites, or • Social media handles.
o. Member Communications & Disputes Members are solely responsible for their communications with other Members. Shubha Kalyana Matrimony reserves the right, but not the obligation, to monitor disputes and take appropriate action against errant Members. However, it is not obliged to disclose such actions to other Members, including complainants. Shubha Kalyana Matrimony expressly disclaims responsibility for any transactions or interactions between Members.
a. Content Responsibility Shubha Kalyana Matrimony disclaims all responsibility for inaccurate, incomplete, false, misleading, unlawful, or otherwise objectionable content posted on the Platform, whether by a User, Member, or due to technical or operational issues. The company does not assume responsibility for the identity, intentions, conduct, or behavior of any User or Member, whether interactions occur on the Platform or outside of it, including offline.
b. Service Disruptions Shubha Kalyana Matrimony assumes no liability for errors, omissions, interruptions, deletions, defects, delays, communication failures, unauthorized access, data breaches, theft, or destruction of communications or data. Members acknowledge that such disruptions may occur and accept that Shubha Kalyana Matrimony shall not be liable for any resulting loss or inconvenience.
c. Technical Failures Shubha Kalyana Matrimony shall not be responsible for malfunctions or technical issues related to telecommunications networks, internet service providers, hardware, servers, software, or other systems used in connection with the Platform. This includes any injury or damage to devices, hardware, software, or data, as well as consequences of server outages or network congestion.
d. Limitation of Liability Under no circumstances shall Shubha Kalyana Matrimony be liable for direct, indirect, incidental, consequential, or special damages, including loss of data, opportunity, financial loss, emotional distress, or reputational harm. Members are expressly advised not to share sensitive personal or financial information (e.g., bank details, credit card information) with other Members. Shubha Kalyana Matrimony disclaims responsibility for any financial loss, fraud, or damages resulting from such disclosures.
e. Facilitative Role The exchange of profiles via the Platform is intended solely as a facilitative tool for matrimonial introductions. It does not constitute an offer, recommendation, or guarantee by Shubha Kalyana Matrimony. The company shall not be liable for any loss, damage, or adverse consequences arising from relationships initiated through the Platform.
f. “As-Is” Basis The Platform and Services are provided strictly on an “as-is” and “as-available” basis, without warranties of any kind. Shubha Kalyana Matrimony expressly disclaims all warranties, including merchantability, fitness for a particular purpose, accuracy, non-infringement, availability, reliability, or outcomes.
g. Verification Limitations Shubha Kalyana Matrimony shall not be liable for content posted by Members, Users, or third parties. Verification of mobile numbers or government-issued identification is conducted solely for basic identity confirmation and does not guarantee genuineness, character, intent, or compatibility. Reliance on such indicators is at the Member's own risk.
h. Civil & Criminal Liability Any civil or criminal liability arising from content posted on the Platform lies solely with the Member, User, or third party who posted it. Shubha Kalyana Matrimony reserves the right to seek indemnification or damages for any harm, loss, liability, or reputational damage caused to the company as a result of such content.
a. Exclusion of Certain Damages In no event shall Shubha Kalyana Matrimony, its affiliates, officers, directors, employees, agents, licensors, or service providers be liable to you or any third party for indirect, incidental, consequential, special, exemplary, or punitive damages. This includes, without limitation, loss of profits, goodwill, data, or other intangible losses, arising out of or connected with your access to or use of the Platform, the Services, or any content therein—even if Shubha Kalyana Matrimony has been advised of the possibility of such damages.
b. Maximum Liability Cap Notwithstanding anything contained in these Terms, the total cumulative liability of Shubha Kalyana Matrimony to you for any claims, losses, damages, liabilities, or causes of action arising under or related to the Platform or Services—whether in contract, tort (including negligence), or otherwise—shall not exceed the total amount actually paid by you to Shubha Kalyana Matrimony for Services during the subsisting term of your paid membership immediately preceding the date on which the claim arose.
a. Introduction Shubha Kalyana Matrimony is committed to providing a safe and responsible platform for all users. We recognize the importance of protecting children and young people from harm and have implemented this Child Safety Policy to ensure that our services are not misused to endanger minors. This policy aligns with Google Play Store's child safety requirements to maintain a secure digital environment.
b. Age Verification & Prevention of Underage Access • Minimum Age Requirement: Registration is strictly limited to individuals aged 21 years and above (male) and 18 years and above (female). • Verification: Members may be required to submit valid documents for age verification at any time. • Account Suspension/Termination: Accounts found to belong to underage individuals will be immediately suspended or terminated. • Parental Controls: Parents are encouraged to use device-level parental control features provided by Google Play to prevent underage access. • Reporting: Users are encouraged to report suspected underage activity through the Platform's reporting mechanism.
c. Prevention of Child Sexual Abuse & Exploitation (CSAE) • Zero Tolerance: Shubha Kalyana Matrimony enforces a strict zero-tolerance policy against CSAE. • Content Moderation: Advanced technology and human moderators are employed to detect and remove any content that depicts, promotes, or facilitates CSAE. • Proactive Measures: AI-based scanning and manual review are used to flag and address inappropriate content. • Law Enforcement Cooperation: The company will fully cooperate with law enforcement agencies in India and internationally in CSAE investigations. • User Education: Safety tips and resources are provided to help users recognize and report inappropriate behavior.
d. User Conduct & Safety Guidelines • Prohibited Activities: Users are strictly prohibited from: - Soliciting or sharing child sexual abuse material. - Communicating with minors for inappropriate purposes. - Sharing personal information that could identify or locate a child. - Engaging in grooming or exploitative behavior. • Compliance with App Features: Interactive features such as chat, forums, or user-generated content comply with Google Play's Families Policy, including content filtering and moderation. • Advertising Compliance: If the app is targeted at children, advertisements comply with Google Play's Families Ads Policy, ensuring they are appropriate and non-personalized.
e. Policy Review & Updates This Child Safety Policy will be reviewed and updated regularly to remain effective and compliant with applicable laws and regulations. • Users will be notified of any changes. • The app undergoes periodic compliance reviews to align with evolving Google Play Store policies.
f. Reporting Concerns • Concerns about child safety on the Platform should be reported immediately to support@shubhakalyanamatrimony.com. • Users may also report concerns to the National Commission for Protection of Child Rights (NCPCR) or their local police station. • Google Play provides mechanisms for reporting policy violations through its official support channels.
a. Governing Law & Jurisdiction By accessing or using the Platform and Services, you expressly agree that any dispute, claim, or controversy arising out of or in connection with the Platform, Services, or this Agreement shall be governed exclusively by the laws of India, without regard to conflict of law principles. All disputes shall be subject to exclusive jurisdiction.
